1. Enforceability<\/strong><\/p>\n\n\n\n

By using the services of APTS CONS M\u00c9TAL<\/strong><\/strong>, the customer accepts the general conditions of sale detailed below. These conditions take precedence over any conflicting clauses that may emanate from the contracting parties.<\/p>\n\n\n\n

2. Price<\/strong><\/p>\n\n\n\n

Only acceptance of the order by the customer is definitively binding. APTS CONS M\u00c9TAL<\/strong><\/strong> on the quote specifications. Container availability is always subject to availability at the time of order. The transport rate may vary each month depending on the fuel surcharge.<\/p>\n\n\n\n

3. Delivery times<\/strong><\/p>\n\n\n\n

Delivery times are provided for informational purposes only and are not binding. Delays cannot result in order cancellation or compensation. Any changes to the work mentioned in the initial quote must be validated by a new quote.<\/p>\n\n\n\n

4. Observation upon delivery and transfer of risks<\/strong><\/p>\n\n\n\n

The customer must check the goods upon receipt and report any visible damage immediately. Any non-visible damage must be reported by registered mail within 15 days.<\/p>\n\n\n\n

5. Retention of title clause<\/strong><\/p>\n\n\n\n

APTS CONS M\u00c9TAL<\/strong> retains ownership of the goods until full payment. In the event of non-payment, the seller may recover the goods and cancel the sale, without refunding the deposits.<\/p>\n\n\n\n

6. Transfer of risks<\/strong><\/p>\n\n\n\n

As soon as the containers are handed over to the customer, the latter becomes responsible for them. The transfer of possession also entails the transfer of risks.<\/p>\n\n\n\n

7. Transfer of transport risks<\/strong><\/p>\n\n\n\n

If transport is provided by the customer or its agents,\u00a0APTS CONS M\u00c9TAL<\/strong>\u00a0is only responsible for loading. All responsibility related to stowage lies with the customer.<\/p>\n\n\n\n

8. Force majeure<\/strong><\/p>\n\n\n\n

APTS CONS M\u00c9TAL<\/strong> will not be liable in the event of force majeure (strikes, natural disasters, wars, etc.), which make the normal performance of obligations impossible.<\/p>\n\n\n\n

9. Payment conditions: Delay and penalty clauses<\/strong><\/p>\n\n\n\n

Services must be paid according to the terms of the quote. In the event of late payment, a penalty equal to one and a half times the legal interest rate will be applied.<\/p>\n\n\n\n

10. Delivery conditions<\/strong><\/p>\n\n\n\n

A \u2013 On-site delivery<\/strong> : The customer must specify the access conditions for delivery trucks. APTS CONS M\u00c9TAL<\/strong><\/strong> will not be responsible for delivery impossibilities and additional costs will be borne by the customer.<\/p>\n\n\n\n

B \u2013 Support on deposit<\/strong> : The customer must check the availability of the container before collection.<\/p>\n\n\n\n

11. Withdrawal<\/strong><\/p>\n\n\n\n

In the event of withdrawal, the deposit paid will not be refunded. If no deposit has been paid, a penalty of 20% of the order amount will be applied.<\/p>\n\n\n\n

12. VAT exemption<\/strong><\/p>\n\n\n\n

For any export order, if no exemption from duty-free purchase is possible, VAT will be invoiced and adjusted according to article 262 of the CGI.<\/p>\n\n\n\n

13. Jurisdiction<\/strong><\/p>\n\n\n\n

Any dispute shall be submitted to the exclusive jurisdiction of the Courts of Bordeaux<\/strong>, even in the event of a warranty claim or multiple defendants.<\/p>","protected":false},"excerpt":{"rendered":"
